An Inner Citadel: Free Will and Law

The general aim of the article is to show that law is a form of existence of commodity production by capital. Specifically, we emphasize that law presupposes the abstractly free will of the subjects whose conduct it governs. In its first section, the article starts from the work of Silvina Bacigalupo and Óscar Correas, who indicate that any justification of punishment presupposes a conception of the will of the subjects. On this basis, the text addresses the basic determinations of human labor in order to discriminate will in its generic character with respect to the specific form it assumes under the capitalist mode of production. In the last section, the text argues that the capacity of the State to sanction subjects rests on the form that their will takes under the capitalist mode of production: the one which makes it devoid of external impediments.References
